NHS trust faces prosecution under duty of candour laws

In the first ever case of its kind, the Care Quality Commission has brought a criminal prosecution against University Hospitals Plymouth Trust under duty of candour laws.

The Trust is accused of breaching the duty of candour regulations, under the Health and Social Care Act 2008, which require hospitals to be candid with families and patients once a safety incident or error has occurred.

They are legally required to divulge what has happened, and offer an apology. The case against the Plymouth Trust is centred around how they communicated with a family after the death of a women during a routine procedure. The case will be heard today.
